什么是backup withholding?

在银行开户或者开办投资账户的时候，填表时会有一项问你是否Subject to backup withholding”，是该填yes还是no呢？

大家都知道发工资的时候，IRS会按你W4表上的数字预扣税，叫做withhold。一般来讲，银行利息及投资所得是不预扣的，但是为了确保税收，IRS规定对一些特殊情况，及IRS认为可能会不能及时收上来的情况，作为后备要预扣28%（2004年的数字）的税，叫做backup withholding。具体分以下几种情况：
  1. 你没有填写W9表向银行/投资行提交你的SSN/TIN等信息；
  2. 你提交了错误的SSN;
  3. IRS发现你以前没有将全部利息，投资所得上报，把你列入了“黑名单”;
  4. 开户填表时当被问道是否要预扣时，你没有明确说“不”。


要注意的是这些表格一般有几种不同的问法，看清楚了是该添yes/no还是exempt，呵呵，总之除非IRS特别通知你，你是NOT subject to backup withholding的。

补充一点，这个backup withholding只是预扣税，跟你的签证身份及最终是否要交税没有关系。比如你是H-1B身份并且税务上讲是resident了，利息就要交税了，但还是不需要这个后备预扣(backup withholding)。
